a. Accurate Information: Users must provide accurate and complete information during the booking process.

b. Age Requirement: Users must be 18 years or older to book through YATR.

c. Compliance: Users must adhere to all applicable laws, regulations, and the terms outlined by the yacht provider.

a. Booking Confirmation: Bookings are subject to availability and are confirmed only upon receipt of full payment or a required deposit, as stated during the booking process.

b. Payment Terms: All payments are processed securely via third-party payment platforms. YATR does not store Users' financial information.

c. Failure to Pay: Failure to make timely payments may result in cancellation of the booking, without refund.

a. Cancellation by User: To cancel or modify a booking, Users must submit a request via the platform by clicking “Request Cancellation” or “Request to Reschedule.” Cancellation and modification terms are governed by the yacht provider's policy, which may include penalties or fees.

b. Cancellation by Provider: YATR is not liable for cancellations initiated by yacht providers. Users will be notified promptly, and refunds or rescheduling options will be provided in accordance with the provider's policy.

c. Force Majeure: YATR is not responsible for cancellations, delays, or modifications caused by events beyond our control, including weather, natural disasters, or government actions.

Users must respect the following guidelines:

a. No disruptive, unlawful, or inappropriate behavior during bookings or use of the platform.

b. No sharing of offensive, fraudulent, or misleading content.

c. Users will be held liable for damages caused by them or their guests to the booked yacht.

a. Third-Party Providers: YATR acts as a facilitator and is not responsible for the actions, negligence, or conduct of third-party yacht providers, captains, or crew.

b. Platform Use: YATR does not guarantee uninterrupted access to the platform and is not liable for technical issues, outages, or errors.

c. Limitations of Liability: YATR's liability, if any, is strictly limited to the amount paid by the User for the booking in question. YATR is not liable for indirect, incidental, or consequential damages.

a. All content on YATR, including logos, graphics, text, and software, is the exclusive property of YATR or its licensors.

b. Users may not copy, distribute, modify, or use YATR's content without prior written consent.

Users agree to indemnify and hold YATR harmless from and against any claims, damages, losses, liabilities, or expenses arising out of:

a. Breach of these Terms by the User.

b. Misconduct, negligence, or unlawful actions by the User during a booking.

c. Violations of third-party rights or applicable laws by the User.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles.

a. Arbitration Clause: Any disputes arising from or related to these Terms or your use of the YATR platform will be resolved through binding arbitration, rather than in court. Arbitration will be conducted by a neutral arbitrator in Palm Beach County, Florida.

b. Waiver of Class Action: Users agree to resolve disputes on an individual basis and waive the right to participate in class actions.

“Company” refers to YATR LLC.

“Affiliate” refers to the individual or entity enrolling in the YATR Affiliate Program.

“Commission” refers to the payout earned by the Affiliate for a successful referral.

“Referral Link” refers to the unique link assigned to each Affiliate to track referrals.

“Successful Referral” refers to a completed and paid yacht charter booking made through the Affiliate's referral link.

To join the program, you must complete the Affiliate registration form on YATR's website and agree to these terms.

YATR reserves the right to approve, deny, or terminate any Affiliate application at its sole discretion without providing a reason.

Affiliates must adhere to all applicable laws, rules, and regulations while promoting YATR.

Affiliates must not:

• Use deceptive, false, or misleading advertising.
• Engage in illegal, unethical, or inappropriate marketing tactics.
• Display YATR materials or logos on websites or platforms with objectionable or offensive content.

Affiliates are responsible for ensuring the proper use of their unique referral link.

The standard commission rate is $500* per successful booking completed through the Affiliate's referral link. (*Commission rates are subject to change without notice)

Commissions are paid monthly, on the first business day of the following calendar month, for bookings completed in the prior month. Example: A booking completed on May 8 will be paid out on June 1.

Payments are processed via selected payment methods and may take 5-7 business days to reach the Affiliate.

YATR reserves the right to adjust the commission rate for specific yachts, promotional campaigns, or partnerships. Affiliates will be notified of any changes in advance.

Affiliates must meet a minimum payout threshold of $500 to qualify for commission disbursement.

All commissions are paid in USD.

Affiliates are responsible for providing accurate bank or payment information. YATR is not liable for delayed or failed payments due to incorrect information provided by the Affiliate.

YATR reserves the right to withhold payment if fraudulent or suspicious activity is detected.

Affiliates are prohibited from:

• Using spam or unauthorized email marketing.
• Bidding on YATR-related keywords for paid search (e.g., YATR trademarks, “YATR charter,” etc.).
• Claiming to be YATR or misrepresenting their relationship with the company.

Marketing materials provided by YATR (e.g., banners, logos) may only be used as authorized and must not be altered without prior written permission.

Affiliates will receive a unique referral link upon approval.

YATR uses cookies to track referrals, which expire after 30 days. If a booking is completed after 30 days, the Affiliate will not receive a commission.

Only one referral link can be credited per booking. If multiple links are used, YATR will attribute the commission to the most recent link.

YATR reserves the right to terminate the Affiliate's participation in the program at any time, with or without cause, and without prior notice.

Grounds for termination include but are not limited to:

• Violation of these terms and conditions.
• Fraudulent activities or suspicious behavior.
• Damage to YATR's reputation due to the Affiliate's actions.

Upon termination, all pending commissions will be forfeited if the Affiliate is found to have violated these terms.

YATR retains all rights to its logos, trademarks, branding materials, and content.

Affiliates are granted a limited, non-exclusive, revocable license to use YATR's materials solely for promoting the Affiliate Program.

Unauthorized use of YATR's intellectual property may result in termination and legal action.

Affiliates agree to indemnify and hold harmless YATR, its parent company, employees, and agents from any claims, damages, or expenses (including attorney fees) arising from:

• Misuse of the Affiliate Program.
• Violation of these terms and conditions.
• Non-compliance with applicable laws.

YATR is not responsible for:

• Technical errors, downtime, or disruptions affecting tracking or payment systems.
• Lost, delayed, or misattributed commissions.
• Indirect, incidental, or consequential damages arising from participation in the Affiliate Program.

YATR's total liability to an Affiliate will not exceed the total commission paid to that Affiliate in the preceding six months.

YATR reserves the right to modify or terminate the Affiliate Program at any time without prior notice.

Affiliates will be notified of material changes to these terms, which will take effect immediately upon posting to the website.

Continued participation in the program constitutes acceptance of updated terms.

Affiliates must keep all program-related information confidential, including but not limited to:

• Commission rates and structures.
• Marketing strategies or unpublished materials.
• Proprietary tracking and reporting systems.

Confidentiality obligations remain in effect indefinitely, even after the Affiliate's participation in the program ends.

These terms and conditions are governed by the laws of the State of Florida, United States.

Any disputes arising from participation in the Affiliate Program will be resolved exclusively in the courts of Palm Beach County, Florida.

These terms represent the entire agreement between YATR and the Affiliate regarding the Affiliate Program and supersede all prior agreements or understandings.

If any provision of these terms is deemed unenforceable, the remaining provisions will remain in full force and effect.
